What is the purpose of Form Publication 1281?
The purpose of Form Publication 1281 is to assist in the collection and filing of tax returns by the employer whose employees fail to qualify for an exemption if the employee is not exempt. The Form 1281 must be filed by the employer with the Department of Labor on or before the 16th day of the 6th month after the year in which the event occurred. What is the payment limitation? In General. The payment limitation includes an amount equal to 50 times (50% of the total tax liability) the employee's tax withholding and remittance, so that the employees who are not fully exempt may be able to repay their taxes. In some circumstances, an employer also may elect to collect the tax on behalf of an exempt employee by reporting (or certifying) the employee as an exempt employee on the Form EPT. In the absence of the payment limitation. An exemption may be granted as part of the Form EPT if, under the terms and conditions of an exemption agreement between the IRS and the employer, a full exemption from U.S. tax is required.
