(Exception: If you file an income tax return or Schedule C that is a joint tax return and the spouses claim more than 10,000 in joint income tax liability for the 2023 calendar year (the tax year in which this section becomes effective), the back-up withholding rules do not apply to the spouses. Back-up withholding rules also do not apply to individuals who qualify on Form 1040-X.
